These Terms of Service ("Terms") govern your use of the STech Cable Billing Android application (the "App") provided by Smartgem Technologies ("we", "our", "us").
By installing, accessing, or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the App.
1. Description of the Service
The App is an offline-first billing and collections tool for cable television operators. It allows you to:
- Register and manage subscriber (customer) records.
- Track monthly payments and billing history in a ledger.
- Generate and export CSV reports and JSON backups.
- Optionally upload a backup file to your personal Google Drive.
- Manage operator accounts, password recovery, and language preferences (English / Tamil).
The App operates primarily on your device, using data you enter. No part of the daily operation requires a network connection.
2. Your responsibilities
You agree to use the App lawfully and responsibly, and to:
- Provide accurate and truthful information when entering customer, payment, and account data.
- Maintain your own backups using the App's export/backup features, especially before restoring a backup or changing devices. Data stored only on a device can be lost if the device is lost, damaged, reset, or the App is uninstalled.
- Keep your login credentials safe and not share them with others.
- Respect applicable privacy laws when handling your subscribers' personal information. As the operator, you are responsible for how you use and disclose the data you manage with the App.
- Not use the App for any unlawful, fraudulent, or harmful purpose.
3. Backups, restore, and Google Drive
- Backups you export (JSON) are stored wherever you choose to save them.
- Restoring a backup replaces your current in-app data. Before restoring, export a fresh backup to avoid losing newer records.
- The optional Google Drive upload stores a copy of your backup file in your own Google Drive via Google's services. The use of Google Drive is governed by Google's own terms and policies. We are not responsible for the availability, operation, or security of Google's services, or for data stored there.
- You are responsible for managing, securing, and deleting backups stored in your Google Drive or elsewhere.
4. Acceptable use
You may not, directly or indirectly:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App (except to the extent permitted by applicable law).
- Copy, modify, rent, lease, loan, sell, or redistribute the App or its content.
- Use the App to store or transmit unlawful, infringing, or malicious content.
- Interfere with or disrupt the operation of the App, or attempt to gain unauthorized access to any systems connected with the App.
5. Intellectual property
The App, including its code, design, graphics, and branding ("STech Cable Billing" and "STech"), is the property of Smartgem Technologies and is protected by applicable intellectual property laws. No license or right to any of our trademarks or copyrighted material is granted to you except to use the App as permitted by these Terms.
Customer and billing data you enter belongs to you (subject to third-party rights).
6. Disclaimer of warranties
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that defects will be corrected, or that data will not be lost.
You use the App at your own risk, and you are responsible for back-ups and for verifying the accuracy of your records.
7. Limitation of liability
To the maximum extent permitted by law, Smartgem Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the App — including loss of billing or subscriber data, or failure of Google Drive backups.
Our total liability for all claims arising from the App shall not exceed the amount you paid for the App (if any).
8. Termination
You may stop using the App at any time by uninstalling it and deleting the stored data on your device. We may terminate or suspend your access to the App at any time if you violate these Terms. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) will survive.
9. Third-party services
The optional backup upload to Google Drive uses Google's APIs and services, which are subject to Google's terms, privacy policy, and developer policies. We are not responsible for Google's services. You authorize and agree to the sign-in and Drive scopes the App requests (limited to files created by the App).
10. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above will reflect the latest revision. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the competent courts located in India.
